Mit Beschlüssen vom 01.09.2022 hat der 19. Zivilsenat des Oberlandesgerichts Köln festgestellt, dass die von Gesellschaften mit satzungsmäßigem Sitz in Deutschland im Jahr 2021 gegen einen souveränen EU-Staat auf Grundlage des Energiecharta-Vertrages (ECV) vor dem Internationalen Zentrum zur Beilegung von Investitionsstreitigkeiten (International Centre for Settlement of Investment Disputes) eingeleiteten schiedsrichterlichen Verfahren unzulässig sind. Zudem hat der Senat jeweils festgestellt, dass schiedsrichterliche Verfahren zwischen den Streitparteien auf Grundlage des Energiecharta-Vertrages grundsätzlich nicht möglich sind.
