Re: Bacilio Amorrortu v. The Republic of Peru

Dear Mr. Aragón,

On behalf of the Republic of Peru ("Peru"), the Special Commission that represents Peru in International Investment Disputes ("Special Commission"), writes in relation to the Notice of Arbitration ("Notice of Arbitration"), submitted by Mr. Bacilio Amorrortu ("Claimant") under the United States-Peru Trade Promotion Agreement ("TPA"), to communicate that any future correspondence regarding the above-referenced matter shall be addressed to the following representatives:

Peru rejects all claims stated in the Notice of Arbitration - and the factual and legal allegations therein contained. As stated in Oficio No 463-2022-EF/32, Peru reserves all rights, including any jurisdictional objections, for Claimant's failure to satisfy the requirements provided in Article 10.15 (Consultation and Negotiation) and Article 10.16 (Submission of a Claim to Arbitration) of the TPA, prior to commence this arbitration proceeding.

Peru takes this opportunity to inform that it has already commenced the internal procedure to designate external counsel for this matter. The Special Commission anticipates that it will appoint Peru's counsel before October 18, 2022, and will confer with Claimant on any procedural matters, including the applicable arbitration rules, upon such appointment has taken place.
