Argentina: Judicial Change of Rules in Public Utilities' Liability

Introduction
On April 4th, 2005, the Argentine Supreme Court issued the ruling "Angel Estrada y Cía. C/ Resolución 71/96 Secretaría de Energía y Puertos", pursuant to which a privatized public utility, in charge of the electricity distribution in the City of Buenos Aires -a company named EDESUR S. A.- was held liable for damages caused to a consumer, beyond the liability caps existing in the regulatory framework.
