The Netherlands government operated a tariff system for the supply of natural gas for the use of amonia which was alleged by the applicants as amounting to state aid violating the EEC Treaty. Subsequently, a new tariff system was introduced. The applicants alleged that this tariff system was discriminatory and violates the state aid principles of the Treaty. The ECJ found that the new tariff system was discriminatory and involves state aid.
