Ms. Berry is an accomplished regulatory and corporate attorney with twelve years of experience in the energy industry. Ms. Berry has experience appearing in a variety of proceedings before the Federal Energy Regulatory Commission (FERC), state commissions and the U.S. Courts of Appeals advising clients in the electric and natural gas industries on matters related to the rates, terms and conditions of service. She has extensive experience representing an Independent Transmission System Operator (ISO) at FERC and in various appellate court proceedings concerning matters of wholesale market design, including the design and implementation of a capacity market, and represents clients who are active in the RTO wholesale markets. Ms. Berry also advised RTOs, electric and natural gas utilities and energy companies on regulatory and compliance matters.
Ms. Berry has substantial expertise in multiple aspects of corporate energy representation including mergers and acquisitions, project development, complex contract negotiation and drafting, and litigation. A representation of Ms. Berry's corporate and transaction experience includes negotiating pro forma rate schedules and cost-based formula rate agreements, reviewing and negotiating power supply arrangements, including contracts for capacity, energy and related services, and negotiating purchase and sale agreements.
Ms. Berry's clients have included RTO/ISOs (U.S. and Canadian), project developers, independent power producers, public power entities, municipalities and rural electric cooperatives, public utilities, large industrial users, gas pipelines and local distribution companies.
