Definitions
The term "Service" shall mean any of TDM, OGEL, OGEMID, Young-OGEMID or OGELForum or any affiliate of any of them, and "Services" shall mean all of them.
The term "Protected Party" shall mean any of (i) MARIS BV, (ii) Camko Ltd, (iii) any direct or indirect owners, members, publisher(s), editors or advisors of any Service, (iv) any officers, employees, administrators, contractors, agents or affiliates of any Protected Party referred to in clauses (i), (ii) or (ii) above, or (v) any moderators or rapporteurs of OGEMID, Young-OGEMID or OGELForum or any editors of TDM or OGEL, or (vi) any employers, employees or other colleagues of a moderator, rapporteur or editor; and "Protected Parties" shall mean all of them.
Introduction
Your use of any of the Services is subject to the terms, conditions and understandings detailed below. By accessing any of the Services, you hereby acknowledge that you have read and accept all of our terms, conditions and understandings. OGEL reserves the right to modify any part of these Terms and Conditions at any time without prior notice. Continued use of any of the Services constitutes acceptance of these Terms and Conditions and any modifications thereof.
Limitations of Liability
None of the Protected Parties assumes any liability for the conduct of any OGEMID, Young-OGEMID or OGELForum list user or Service subscriber. Messages sent by any user of, or subscriber to, a Service to OGEMID, Young-OGEMID or OGELForum are not reviewed, screened or edited, and no Protected Party assumes any responsibility for the content of such messages. By registering your email address enabling you to participate in any of the Services, you accept sole responsibility for any message that you or your affiliated persons post.
List users and subscribers may contact OGEL at info@maris.nl about any breach of this acceptable use policy, and we may in our sole discretion take any of the following actions if it is thought appropriate:
- Contact the party or parties responsible to discuss the problem
- Remove them from Service membership
- Contact their hosting site, employing organisation, or service provider
- Restrict email from certain sites or addresses
- Remove inappropriate messages from the OGEMID, Young-OGEMID and OGELForum archives
- Make a public announcement to those affected
The decision on what action, if any, is appropriate will be made by Maris BV and Camko Ltd in their sole discretion and on a case by case basis. The action taken may depend on whether the infraction was innocent, inadvertent or intentional.
If a complaint is received at info@maris.nl about a message sent to OGEMID, Young-OGEMID or OGELForum, we reserve the right in our sole discretion to remove the message from our archives immediately and prior to consulting the originator of the message.
Indemnity
As a user of, or subscriber to, any of the Services and by registering your email you hereby agree to indemnify and hold harmless each and every Protected Party on demand from and against any and all claims and liabilities arising out of the use by you or any of your affiliates any of the Services.
Copyright notice
The information contained in the Services is protected by copyright and all rights are reserved to TDM and OGEL and to contributing authors. Prior to accessing the information or other materials contained on any of the Services you have to register. Once registered you are authorised to download and print one copy of the articles on the TDM and OGEL websites for your internal educational or professional use or for providing services to your clients provided all printouts clearly include the name of the author and of TDM or OGEL, as the case may be. The work so downloaded must not be modified. Copies downloaded must not be further circulated. Each individual wishing to download a copy must first register with OGEL.
All other use including copying, distribution, retransmission or modification of the information or materials contained on any of the Services without the express written consent of OGEL is strictly prohibited. Should a user or subscriber contravene these conditions OGEL reserves the right, without limitation of any other right or remedy, to send a bill for the unauthorised use to the party or parties engaging in such unauthorised use. The bill will charge to the unauthorised user or subscriber a sum which takes into account the copyright fee and administrative costs of identifying and pursuing the unauthorised user or subscriber.
Usage
Comprehensive downloading and storage on institutional or private systems is not allowed. MARIS BV monitors usage and has the right to intervene if this type of downloading has been detected. Intervention may result in restricting the number of allowed downloads per 24 hours or may result in temporarily blocking access to the account (this can be an account used by more than one user, such as those users with IP range-based authentication) until the subscriber has taken steps to prevent this type of downloading.
Comprehensive downloading and storage on institutional or private systems will attract additional yearly license fees calculated at the cumulative maximum corporate fee covering all prior years of OGEL publication (starting in 2003), i.e., the maximum corporate fee that would have been payable for a subscription for each year from and after 2003.
Job advertisements
Job advertisements may contain inaccuracies or typographical errors. OGEL/TDM makes no representations about the accuracy, reliability, completeness, or timeliness of the advertisement. Changes may be made at any time.
Parties advertising the vacancy are solely responsible for their postings. OGEL/TDM is not to be considered to be an employer with respect to your use of any of the Services and shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on the OGEL/TDM websites.
Before posting job advertisements on the OGEMID, Young-OGEMID or OGELForum Services, please contact MARIS BV first. Any advertisements require previous consent by MARIS BV.
Advertising, sponsorship and etc.
Advertising, sponsorship or other support by any of the Services for conferences and similar events is a matter within the authority of the Publisher, MARIS BV. No other Protected Party is entitled in any capacity to make decisions as to such matters. Members of the Editorial Committee may receive a modest honorarium for their service, but are not compensated in whole or in part by reference to the performance of any of the Services.
The Contributor guarantees that:
- They are the sole author and copyright owner of the Contribution (or, if co-authored, jointly with the co-author).
- The work is original, unpublished elsewhere, and does not infringe on any rights, present work or ideas from another source by incorporating it into the Contribution without full acknowledgement, or contain unlawful material. Should the work, or any part thereof, have been previously published elsewhere or as a derivative work, the Contributor has obtained written permission from the original publisher for its republication in our journal.
- All necessary written permissions have been obtained for quoted copyrighted material or illustrations used beyond fair academic practice.
The Contributor also agrees to indemnify and hold harmless the Publisher and its affiliates from any claims, losses, or damages arising from copyright infringement or breach of these guarantees due to the publication of the Contribution.
Disclaimer of liabilities and responsibilities
Without limitation of any other provisions of these Terms and Conditions and to the fullest extent permitted by applicable law:
- The information provided on any Service is for general informational purposes only. None of the Protected Parties makes any representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability of any information, products, services or other material contained or referred to in any of the Services. Any information on any of the Services is provided on an "as-is" basis without warranties of any kind whether express or implied, including without limitation warranties of merchantability, fitness for ordinary or particular purpose and non-infringement. Each Protected Party expressly disclaims all liability and responsibility with respect to actions taken or not taken, or any other conduct, based upon the information contained on any of the Services or with respect to any errors or omissions in such information. Any reliance that any user of, or subscriber to, any Service places on such information is strictly at that subscriber's or user's own risk.
- Nothing on any Service or any statements by or on behalf of any Protected Party constitutes legal, financial, commercial, investment, regulatory or other professional advice. Information shared by any Protected Party is not to be construed as creating an attorney-client or other professional relationship. Users of, and subscribers to, a Service should consult with qualified legal, financial, regulatory, investment, commercial and other relevant professionals for advice regarding their specific matters or circumstances.
- No legal, commercial, financial, investment, regulatory or other professional information, materials, recommendation, guidance or advice shared on a Service constitutes legal, regulatory, financial, investment, commercial or other professional advice by any Protected Party, user or subscriber. None of the Protected Parties endorses any products, services, or entities that may be discussed or referred to on any Service. Users of, and subscribers to, a Service should conduct their own research and consult with appropriate professionals before making any legal, commercial, financial, regulatory or other professional decisions.
- None of the Protected Parties can guarantee security of data or other information transmitted through a Service. Users of, and subscribers to, a Service participate at their own risk and should avoid sharing sensitive personal or professional data and information when using such services.
- All opinions, advice, statements, and other information expressed by users of, or subscribers to, a Service are those of the individual users and subscribers and are not necessarily those of any Protected Party. None of the Protected Parties controls, monitors or endorses the content posted by users of, or subscribers to, any Service or assumes any responsibility for such content.
- A Service may contain links to media, websites, lists, applications or other resources. None of the Protected Parties has any control over the nature, content or availability of any thereof nor does any Protected Party assume any liability or responsibility for their content or practices or the timeliness, sequence, accuracy or completeness of any information or other material referred to therein. None of the Services incorporates by reference any materials or other information appearing in such linked locations.
- In no event shall any Protected Party be liable or responsible for any direct, indirect, incidental, special, consequential or punitive damages arising out of the use by any user or subscriber, or any affiliate of any user or subscriber, of a Service or of any information derived therefrom, even if such Protected Party has been advised of the possibility of such damages.
Severability
If any provision of these Terms and Conditions is held to be unenforceable in any jurisdiction, that particular provision alone shall be severed from the remainder of these Terms and Conditions for purposes only of that jurisdiction and no other. All other provisions of these Terms and Conditions shall remain fully enforceable in that jurisdiction.
Governing law
These Terms and Conditions shall be governed by and construed in accordance with the law of The Kingdom of the Netherlands, without regard to any conflict of law provisions.
