Introduction
The jurisprudence of the International Centre for Settlement of Investment Disputes (ICSID) on jurisdiction is setting the criteria in areas where it was unclear whether an investment legal dispute fell or did not fall under its authority. Recent cases have dealt with issues such as the definition of investments in the case of construction operation, acts of a court of a State as attributable to the latter, continuity of nationality, right of minority shareholders to access to ICSID and the 'umbrella' clause.
