Introduction
Two recent events have reconfirmed the supremacy of the Federal Energy Regulatory Commission (FERC) over the permitting and regulation of onshore LNG facilities in the U.S. First, FERC issued a declaratory order on March 24, 2004, where it held that regulatory authority for the siting, construction and operation of liquefied natural gas (LNG) import terminals rests exclusively with the federal government.
