This contribution aims to summarize and evaluate the state of play of the Energy Charter Treaty (ECT) by focusing on the renewable energy (RES) awards that so far have been published against Spain. Subsequently, the potential impact of the Achmea judgment on ECT arbitral tribunals is discussed. The outlook will discuss the potential way forward. However, before starting the analysis and for a better understanding, the relevant EU and Spanish legislative framework for RES will be shortly outlined.
