Abstract

Negotiation dispute resolution clauses with multiple tiers are gaining popularity in offshore oil and gas contracts. However, there may be issues with enforceability. Therefore, this article explores how courts assess the binding nature of such clauses based on their clarity, specificity, and structural integrity. The analysis highlights that English courts are increasingly willing to uphold well-drafted clauses that impose mandatory obligations and provide a clear procedural framework.
