Summary
Although challenges to enforcement of criminal liability for environmental damage are not peculiar to developing countries, the Bhopal gas leak disaster highlights the acute nature of this problem in developing countries. Almost two decades after, criminal prosecution in a disaster of Bhopal's magnitude is yet to be concluded. This contrasts very significantly with examples from developed countries such as the Exxon Valdez oil spill of the United States and the Sea Empress of the United Kingdom.
