This note is dedicated to Ibrahim Shihata, the former Senior Vice-President and General Counsel of the World Bank and Secretary-General of the World Bank's ICSID arbitration tribunal. I had known Shihata for about 20 years, starting with a meeting at the OPEC Special Fund in Vienna.
