Introduction
This note is dedicated to Ibrahim Shihata, the former Senior Vice-President and General Counsel of the World Bank and Secretary-General of the World Bank's ICSID arbitration tribunal. I had known Shihata for about 20 years, starting with a meeting at the OPEC Special Fund in Vienna. We had built already during his career a relationship with him; he advised on the creation of our international business programme and obtained an honourary doctorate from the University of Dundee, on the nomination of the Centre for Energy, Petroleum and Mineral Law and Policy.
