An Overview on the Legal and Contractual Challenges Facing Hydrogen Projects: Climate Change and SDGs Perspective
Published 27 May 2024
Abstract
This research paper delves into the legal and contractual challenges encountered by hydrogen projects, focusing on their implications from a climate change and Sustainable Development Goals (SDGs) perspective. The international community's commitment to mitigating greenhouse gas emissions and promoting sustainable development through major agreements like the Kyoto Protocol, UNFCCC, and Paris Agreement sets the stage for understanding the regulatory landscape. National laws and regulations, exemplified by the United States' Department of Energy's role in advancing hydrogen technology, highlight the importance of governmental support. The paper emphasizes the need for a flexible contractual framework and innovative risk allocation strategies to facilitate the growth of hydrogen projects, drawing insights from successful industry projects. Recommendations for future hydrogen projects stress the significance of assessing risks, utilizing international law principles, and advocating for legislative reforms to create a conducive legal environment. By exploring case studies and industry practices, this paper aims to provide valuable insights for stakeholders navigating the complexities of hydrogen projects in the context of climate change and sustainable development goals.
