The Significance of Data Protection and Information Security in Nigeria's Oil and Gas Industry: Legal Considerations

(Minor revisions 17/04/2025) Through a legal prism, this article strives to demonstrate the importance of safeguarding data in Nigeria’s (most critical) oil and gas industry. The oil and gas sector forms a huge interest to any country endowed with hydrocarbons. Following this, the protection of data and information regarding this natural deposit and its operations becomes imperative. Moreover, the advent of technology has fanned the flames of malicious intrusions and cyber-attacks relating to one’s personal information. Such data cum security breach incidents leads to the unauthorized access and use of personal and sensitive data belonging to individuals or organizations - of which the repercussions are devastating. Bad actors target significant sectors of the economy, like the oil and gas industry, in a bid to gain access to sensitive/personal data they deem valuable. They perpetrate fraud, extortions, digital robbery and identity theft with such information, leading to disruptions in oil and gas operations - of which the daily lives of all depend. As a result of the digitization and digitalization of the oil and gas industry, data protection and information security have become pertinent to curb the risks that accompany the collection, processing, use and disclosure of (personal and sensitive) data by oil and gas entities. Such negative implications could be: disruptions of operations; compromise of confidentiality, integrity and access to data; damaged reputation; lack of confidence in the sector by all stakeholders; expensive ransom payouts; heavy litigation fees and heightened penalties. These detrimental ramifications could be counterbalanced by the anticipated economic advantages obtained from the adoption of these advanced technologies. It is possible for a nation to desire and achieve a prosperous oil and gas sector free from adverse economic and social impacts caused by data breaches and security incidents. To attain this, oil and gas entities must take cognizance of the challenges associated with the utilization of digital technologies. They must also acknowledge, understand and comply with all relevant data protection/information security laws and regulations; employ the services of data protection and information security experts/personnel; study and draw lessons from global and local data/security breach incidents and adopt unassailable information security programs. This piece suggests that other than the existing legislation regarding data protection in the oil and gas industry, there should also be the creation of sector-specific data protection regulations or guidelines aimed at undertaking the uniqueness of Nigeria’s oil and gas (upstream, midstream and downstream) operations.
