Summary

Faits et procédure

1. Selon l'arrêt attaqué (Paris, 4 mai 2021), le 2 février 2000, la société italienne Bechetti Energy Group S.p.a, (la société BEG), a conclu avec la société italienne Enelpower, appartenant au groupe Enel, un accord de coopération pour la construction et l'exploitation d'une centrale hydroélectrique en Albanie.

2. La société Enelpower ayant décidé de ne pas poursuivre le projet, la société BEG a, en application de la clause compromissoire stipulée par le contrat, saisi un tribunal arbitral siégeant à [Localité 4] de demandes indemnitaires qui ont été rejetées par une sentence du 6 décembre 2002, déclarée exécutoire en Italie par une décision du 19 décembre 2003 confirmée par un arrêt du 9 mars 2009.

3. En mai 2004, la société albanaise Albania BEG Ambient (la société ABA), créée par la société BEG pour la réalisation du projet de centrale, estimant qu'elle avait été maintenue par le groupe Enel dans la croyance que ce projet se réaliserait, a assigné les sociétés Enel et Enelpower devant une juridiction albanaise en paiement de dommages-intérêts.

4. Par jugement du 24 mars 2009 confirmé en appel, le tribunal albanais a condamné les sociétés Enel et Enelpower à payer à la société ABA diverses sommes en réparation de son préjudice extra-contractuel.

5. La société ABA a sollicité l'exequatur de ce jugement.

Recevabilité du pourvoi contestée par la défense

6. Les sociétés Enel et Enelpower soulèvent l'irrecevabilité du pourvoi au motif que, dans sa déclaration de pourvoi du 21 juin 2021, la société ABA a déclaré être domiciliée à une adresse, qui indiquée comme étant celle de son siège social, n'était plus la sienne dès lors que l'huissier de justice chargé de l'exécution de l'arrêt attaqué, s'est heurté à une impossibilité de notifier l'acte, le ministère de la justice de la République d'Albanie ayant fait connaître, à la suite de la demande d'aide juridique du 12 juillet 2021, l'impossibilité constatée par le tribunal du district judiciaire de Tirana le 24 novembre 2021 de trouver cette personne morale à l'adresse fournie.

7. S'il résulte de l'article 975 du code de procédure civile que la déclaration de pourvoi comporte, à peine de nullité, l'indication du domicile du demandeur à la cassation, aucun texte ne lui impose de faire connaître son changement de domicile ultérieur.

8. La tentative de signification engagée le 12 juillet 2021 n'établit pas que, le 21 juin 2021, l'adresse mentionnée par la société ABA, dans sa déclaration de pourvoi, n'était plus la sienne.

9. Le pourvoi est donc recevable.
