De zaak in het kort

1.1 Deze zaak gaat over een verzoek tot het verlenen van een verlof tot tenuitvoerlegging (exequatur) van een arbitraal vonnis gewezen in het Verenigd Koninkrijk waarbij NIOC is veroordeeld om een bedrag te betalen aan Crescent c.s. De rechtbank heeft het verlof gegeven. Aan de orde is of NIOC in hoger beroep kon komen met het oog op het zogenoemde “asymmetrische appelverbod” in exequaturverzoeken die vallen onder het Verdrag over de erkenning en tenuitvoerlegging van buitenlandse scheidsrechterlijke uitspraken uit 1958 (hierna: het Verdrag van New York), en of zich een zogenoemde doorbrekingsgrond van dit appelverbod voordoet.

1.2 Het hof komt tot het oordeel dat het asymmetrische appelverbod van toepassing is. NIOC kan niettemin in haar hoger beroep worden ontvangen omdat zij doorbrekingsgronden stelt. Het hof komt echter tot het oordeel dat het beroep op de gestelde doorbrekingsgronden, waaronder schending van het beginsel van hoor en wederhoor, niet slaagt.
