JUDGMENT

1. I have considered this application to appeal and the objections which have been filed at the Court Registry.

I make no comment about the prospects of success in an appeal.

2. However, I do consider there are compelling reasons for granting permission to appeal in this case. As in the case of Posco (where permission to appeal has been granted) the case involves an important issue about which judges at first instance have expressed different views. In these circumstances, I consider that there is a compelling need for the matter to be resolved at appellate level.

3. Accordingly, I give permission to appeal.
